Sale and purchase of condominiums is governed by the Condominium Act of 1979 with its amendment of 2008. An English translation can be found here:

Foreigners can in fact own a condominium in their own name. Up to 49% of the units in a condominium building may be owned by foreigners. On the resale market, units in a foreigner’s name are trading with slightly higher prices than condominiums under local Thai ownership.

However, since Thai companies are considered “Thai juristic persons” it is also possible to own a condo through a Thai company.

The best solution depends on the buyer’s individual situation and requirements of the real estate investor, and should always be subject to legal and tax counselling.

Obtaining a Mortgage when Buying a Condo in Thailand

Foreigners are entitled to acquire mortgages in their favour as collateral for financial support to Thai persons or Thai companies. There is no period limit on such mortgages.
